1. Who We Are
Touchable AI creates personalized, AI-generated custom card products — including tarot decks,couples question card decks, and playing cards — featuring your likeness, designed with you in mind.
2. Acceptance of Terms
By visiting our website, placing an order, or submitting photos or content through our platform, you confirm that you have read, understood, and agree to these Terms of Service. If you do not agree, please do not use our site or services.
3. Products & Personalization
Touchable AI offers AI-generated custom products. Because every product is made specifically for you, please note the following:
AI-Generated Results: Our products are created using artificial intelligence. Final outputs may vary from previews or mockups shown during the ordering process. Variation in likeness, style, and design detail is inherent to AI-generated content and does not constitute a defect.
Order Accuracy: You are responsible for reviewing your order details — including submitted photos, names, and customization instructions — before completing your purchase. We are not responsible for errors resulting from incorrect or incomplete information provided by you.
Product Previews: Any previews, mockups, or sample images shown on our website are illustrative. Your final product may differ in appearance.
4. Photo & Content Submissions
By submitting photos or other content to Touchable AI, you confirm and agree to the following:
You own the rights to every photo and piece of content you submit, or have explicit permission from the person(s) depicted.
You are not submitting photos of minors, images depicting nudity, or any content that is illegal, defamatory, or violates the rights of any third party.
You grant Touchable AI a limited, non-exclusive license to use your submitted content solely for the purpose of creating and fulfilling your order.
Touchable AI does not use customer-submitted photos to train AI models or for any purpose beyond your order and related customer support.
By submitting photos of yourself or others, you take full responsibility for having the right to do so.
Touchable AI reserves the right to refuse or cancel any order containing content we deem inappropriate, illegal, or in violation of these terms.
5. Refund & Return Policy
Because every Touchable AI product is made to order and uniquely personalized, we do not accept returns or offer refunds except in the following circumstances:
Your order arrives damaged or defective
You receive the wrong item
Your order is lost in transit and confirmed undelivered
If any of the above apply, contact us at hello@touchable.ai within 14 days of your expected delivery date with your order number and photos of the issue. We will work with you to resolve it through a replacement or store credit at our discretion.
We do not offer refunds based on dissatisfaction with AI-generated results, variations from previews, or change of mind after an order is placed.
6. Shipping & Delivery
Estimated shipping and production timelines are provided at checkout and are estimates only, not guarantees.
Touchable AI is not responsible for delays caused by shipping carriers, customs, weather, or other circumstances outside our control.
We are not responsible for orders delivered to an incorrect address provided by the customer.
Risk of loss and title for products passes to you upon handoff to the shipping carrier.
7. Intellectual Property
All content on the Touchable AI website - including designs, copy, branding, AI-generated templates, and technology — is the property of Touchable AI and protected by applicable intellectual property laws.
When you purchase a custom product, you receive a physical product and a personal, non-commercial license to use images of that product. You may not reproduce, resell, or distribute Touchable AI's designs, templates, or underlying technology without our written permission.
You retain ownership of the photos you submit. Touchable AI retains ownership of the AI-generated designs, templates, and creative elements used to produce your product.
8. Payment
All payments are processed securely through third-party payment processors. By completing a purchase, you authorize the charge to your selected payment method for the full order amount including applicable taxes and shipping.
If a payment is disputed or charged back without valid cause after an order has been produced and shipped, Touchable AI reserves the right to pursue recovery of costs incurred.
9. Prohibited Use
You agree not to use our website or services to:
Submit content that is illegal, defamatory, obscene, or infringes on any third party's rights
Impersonate any person or entity
Attempt to gain unauthorized access to our systems
Use automated tools to scrape or interact with our site without permission
Resell or commercially exploit our products or platform without written authorization
10. Limitation of Liability
To the fullest extent permitted by law, Touchable AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services, including dissatisfaction with AI-generated results, shipping delays, or data loss.
Our total liability to you for any claim shall not exceed the amount you paid for the specific order giving rise to the claim.
11. Disclaimer of Warranties
Our products and services are provided "as is." Touchable AI makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any product or service, beyond what is expressly stated at the time of purchase.
12. Governing Law
These Terms of Service are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in New York, NY.
8. Changes to These Terms
Touchable AI may update these Terms of Service from time to time. Changes will be posted on this page with an updated "last revised" date. Continued use of our site or services after changes are posted constitutes your acceptance of the revised terms.
